Patna High Court Orders Removal of Bihar Congress’s AI Video on PM Modi’s Late Mother
The Patna High Court on Wednesday (September 17) directed the removal of an AI-generated video released by the Bihar Congress that depicted Prime Minister Narendra Modi and his late mother, Heeraben Modi. The Court instructed social media platforms to immediately stop the circulation of the video, citing Supreme Court rulings that recognise the right to privacy and dignity as fundamental rights.
A bench of Acting Chief Justice PB Bajanthri and Justice Alok Kumar Sinha passed the order while hearing a Public Interest Litigation (PIL) filed by Vivekanand Singh. The PIL sought removal of the video, which showed the Prime Minister dreaming of his mother reprimanding him for his policies.
The Court noted that further circulation of such a video would cause harm and, therefore, directed intermediaries—Meta Platforms, Google India (YouTube) and X (Twitter) India—not to allow its sharing until further orders.
Notices have also been issued to the Union Government, Bihar Government, Bihar Pradesh Congress Committee, the Election Commission of India, and Congress leader Rahul Gandhi.
The petitioner argued that the video was “disgusting, disgraceful, and dishonouring,” violating the dignity of the Prime Minister’s late mother. Senior Advocate Santosh Kumar, appearing for the petitioner, further submitted that the video’s release coincided with pitru paksh, when the Prime Minister was performing rituals for his mother, making the act even more insensitive. He also pointed out that one of the policies mocked in the video—demonetisation—was already upheld by the Supreme Court.
