Delhi High Court Stops Sale of Fake Little Hearts Biscuits, Orders Amazon Takedown

The Delhi High Court has stopped the manufacture and sale of fake Little Hearts biscuits that were being sold online using Britannia’s trademark and product design. The Court also directed Amazon to immediately remove such products from its website.

The interim order was passed by Justice Manmeet Pritam Singh Arora after Britannia Industries Ltd approached the Court alleging trademark infringement.

Britannia informed the Court that it has been using the Little Hearts brand name since 1988 and introduced its well-known sugar-coated, heart-shaped biscuits in 1993. The company holds registered trademark rights not only over the name “Little Hearts” but also over the unique 3D heart shape of the biscuit.

According to Britannia, it discovered that biscuits were being sold on Amazon under the name “Little Hearts” by Shri Swastik Organics and others. These listings allegedly used Britannia’s product name and showed images copied from Britannia’s original packaging, which could mislead consumers into believing that the products were genuine.

After reviewing the material, the Court observed that the defendants had dishonestly adopted Britannia’s trademark and product shape with the intention of taking unfair advantage of the brand’s goodwill and reputation built over several decades.

The Court restrained the defendants and all related persons from manufacturing, selling, advertising, or dealing in biscuits using the name “Little Hearts” or any mark or shape that is identical or deceptively similar to Britannia’s registered trademarks. Amazon was also asked to ensure that such infringing listings are taken down from its platform.

Advocates Sagar Chandra, Ishani Chandra, Shubhie Wahi, Sanya Kapoor, and Mansha Bhatia appeared on behalf of Britannia. No one appeared for the defendants.
