Delhi High Court Issues Notice on Priya Kapur’s Plea to Dismiss Suit Over Alleged Fraudulent Family Trust
The Delhi High Court has issued notice on an application filed by Priya Kapur, wife of late industrialist Sunjay Kapur, seeking dismissal of a civil suit filed by her mother-in-law, Rani Kapur.
The case is being heard by Justice Mini Pushkarna, who has directed Rani Kapur to file her response within four weeks. Priya Kapur may file a rejoinder within two weeks thereafter. The matter is now listed for hearing on March 23.
What Is the Dispute About?
Rani Kapur, aged 80, has filed a suit alleging that Priya Kapur and others created a “fraudulent family trust” to unlawfully divert her entire estate and family legacy. She claims that the “RK Family Trust” (also referred to as the Rani Kapur Family Trust) is illegal, void and created without her knowledge or consent.
According to her, the alleged fraud came to light only after the death of her son, Sunjay Kapur, in June 2025.
Priya Kapur’s Application for Dismissal
Priya Kapur has moved an application under Section 151 of the Code of Civil Procedure (CPC), arguing that the suit is a gross abuse of the court process. She has alleged that Rani Kapur concealed important facts and made false statements before the court.
In addition, another application has been filed under Section 279 read with Section 227 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).

Background of the Estate
Rani Kapur is the widow of Dr. Surinder Kapur, promoter of the Sona Group of Companies. Dr. Kapur passed away in June 2015, leaving behind a Will dated February 6, 2013. As per the Will, his entire estate — including shareholding in Sona Group companies — was left to Rani Kapur.
The Will was probated by the Bombay High Court in January 2016 after all three children gave their no-objection.
Allegations in the Suit
Rani Kapur has alleged that:
- Her assets were siphoned off through complex and illegal transactions.
- The RK Family Trust was created around October 2017 without her consent.
- After Sunjay Kapur’s death, Priya Kapur quickly assumed control over key Sona Group companies.
- She was appointed director and managing director within days of the funeral.
- Rani Kapur’s access to company information was blocked.
- Her email account was falsely claimed to be “hacked”.
- A new email ID was allegedly created without her knowledge to make changes in trust and company management.
She has described the trust as “illegal, fraudulent and unregistered” and has sought restoration of her entire estate as it existed before the creation of the trust.
Related Proceedings
Earlier, the High Court had issued summons in the suit filed against Priya Kapur and others, including members of the extended family. The suit names 23 defendants.
In a related development, the Court has also reserved its order on interim relief sought by Samaira Kapur and her brother in a separate suit claiming a share in their late father’s personal assets.
The case now moves to the next stage, where the Court will consider whether the suit should proceed or be dismissed at the threshold.
