Menaka Guruswamy Elected to Rajya Sabha, Becomes India’s First Openly Queer MP
Senior Advocate Menaka Guruswamy has been elected to the Rajya Sabha from West Bengal, marking a historic moment in Indian parliamentary representation. Guruswamy was nominated by the Trinamool Congress (TMC) and secured the seat unopposed. Her election makes her the first openly queer Member of Parliament in India.
The development is seen as a significant step toward greater diversity and representation in Indian politics. Guruswamy is widely recognised in legal circles for her contributions to constitutional law and for her advocacy in landmark rights-based litigation before the Supreme Court.
Her entry into Parliament also reflects the increasing presence of legal professionals in legislative roles. Over the years, several senior advocates and jurists have transitioned into politics, bringing their expertise in law, governance and constitutional matters to the legislative process.
Guruswamy’s election was part of a set of Rajya Sabha seats from West Bengal that were filled without contest. Along with her, several other candidates from different political parties were also elected unopposed.
Among the Trinamool Congress nominees who secured seats were Babul Supriyo, Rajeev Kumar and Koel Mallick. The Bharatiya Janata Party’s candidate Rahul Sinha was also elected unopposed from the State.
The unopposed election indicates a consensus among political parties in the State regarding these nominations. In the case of Guruswamy, the decision by the Trinamool Congress to field her reflects the party’s attempt to broaden representation in Parliament.
Guruswamy has built a distinguished career as a senior advocate practising before the Supreme Court of India. She has appeared in several important constitutional matters and has been associated with cases involving civil liberties, equality and democratic rights.
More recently, she also appeared on behalf of the Trinamool Congress in proceedings challenging searches conducted by the Enforcement Directorate at premises linked to political consultancy firm I-PAC.
Her election to the Rajya Sabha places a prominent legal voice within the Upper House of Parliament. Observers note that her experience in constitutional litigation and public law could contribute to debates on legislative reforms and civil rights.
The milestone of becoming India’s first openly queer Member of Parliament also carries symbolic significance. It highlights the gradual expansion of representation for historically marginalised communities within the country’s democratic institutions.
As Guruswamy prepares to assume her role in Parliament, her appointment is expected to draw attention not only for its legal and political significance but also for the broader message it sends about inclusivity and representation in Indian public life.
