Delhi High Court Grants Ex-Parte Injunction in Copyright Infringement Dispute Over Railway Software
The Delhi High Court has granted an ex-parte ad-interim injunction in favour of Thinvent Technologies Private Limited in a commercial suit alleging unauthorised use of proprietary thin-client software deployed in railway systems.
The matter, CS (COMM) 1359/2025, was argued on behalf of the plaintiff by Mr. Anirudh Bakhru, assisted by the team of King Stubb & Kasiva, with Himanshu Deora (Partner) along with his team Shambhavi Sharma, Sanat Saswadkar and Shambhavi Bharadwaj appearing as counsel.
By its order dated 18 December 2025, the Court restrained Defendant Nos. 1 to 3 from reproducing, installing, distributing, selling, or otherwise using the plaintiff’s copyrighted software, including the Thinvent Manageability and Production Automation Software Suite and Emulation Software, or any derivative works. The Court also directed preservation of all allegedly infringing devices and digital evidence.
The Court held that a prima facie case was made out and that the balance of convenience lay in favour of the plaintiff, noting that continued unauthorised use could cause irreparable harm to its intellectual property rights.
To secure evidence, the Court appointed Local Commissioners to inspect thin-client devices installed at railway premises in Lucknow and Mumbai, with directions to retrieve software and system data while ensuring that no proprietary data of the Indian Railways is compromised.
The matter is next listed before the Joint Registrar on 2 February 2026 and before the Court on 20 May 2026.
