Madras HC Steps In: IP Rights Dispute Over TVK’s Flag Reaches Division Bench

The Madras High Court has issued a notice to Tamilaga Vettri Kazhagam (TVK) leader Vijay in connection with a dispute over the party flag involving allegations of trademark and copyright infringement.

The notice came after Chennai-based trust Thondai Mandala Saandror Dharma Paribalana Sabai challenged an earlier order of a single judge. On August 18, the single judge had refused to restrain TVK from using its party flag.

Dissatisfied with the ruling, the trust filed an appeal before a division bench. The bench, comprising Justices G Jayachandran and M Sudheer Kumar, has now listed the matter for further hearing after six weeks.

The trust claims that TVK’s flag infringes upon its intellectual property rights and had initially sought an injunction against its use, which was declined by the single judge. The division bench will now examine the issue in detail.
