Madras High Court Refuses to Halt IPL Matches During Tamil Nadu Elections

The Madras High Court in Prabhakaran v. Chief Election Commissioner declined to entertain a public interest litigation seeking restrictions on Indian Premier League (IPL) matches during the Tamil Nadu election period.

The Bench of Chief Justice SA Dharmadhikari and Justice Arul Murugan observed that the plea was based on speculative concerns rather than any concrete violation. The Court made it clear that such apprehensions alone cannot justify judicial intervention.

The petitioner had requested the Court to either postpone IPL matches until after the elections or ensure strict compliance with the Model Code of Conduct. Additionally, the plea sought a prohibition on political symbols and campaign materials at match venues.

However, the Court emphasised that the responsibility to monitor and act on any breach of the Model Code lies with the Election Commission of India. It reiterated that the Commission is the appropriate authority to handle such matters, as recognised in previous judgements.

The Bench also noted that one IPL match had already been conducted without any reported issue. This, according to the Court, further weakened the petitioner’s claim of possible violations during the ongoing election period.

Highlighting the lack of evidence, the Court remarked that there was no material placed before it to show that any breach had occurred. It stated that courts cannot act merely on hypothetical situations or assumptions.

“It’s a mere apprehension. One match is over. If you are not able to point out anything, what happens? You saw the match or not? What happened? Nothing happened,” the Court observed during the hearing.

In a lighter tone, the Bench added, “You enjoyed the match. Enjoy the second match also.”

At the same time, the Court clarified that individuals are free to approach the Election Commission if they notice any violation of the Model Code of Conduct. The Commission would then take appropriate action in accordance with the law.

Following these observations, the petitioner chose to withdraw the plea.
