Supreme Court Asks Centre: What Benefits for Disabled Military Cadets?

The Supreme Court on Monday (18 August) sought a response from the Central government on how military cadets who suffer disability during training can be given fair support.

The matter was taken up suo motu after a report in The Indian Express highlighted the plight of such cadets. A Bench of Justices BV Nagarathna and R Mahadevan observed that these cadets deserve better benefits as their injuries occur during service to the nation.

The Court said it would examine whether monthly compensation should be increased, whether insurance coverage could be provided, and how the Rights of Persons with Disabilities Act, 2016, can be applied to them. It also discussed rehabilitation, including giving cadets alternative training or desk jobs suited to their condition.

Additional Solicitor General Aishwarya Bhati, appearing for the Centre, assured the Court that a detailed affidavit will be filed.

The Court has issued notices to multiple authorities, including the Ministry of Defence, the Chiefs of the Army, Navy, and Air Force, as well as the Ministry of Social Justice. The case will be heard next on 4 September.

During the hearing, the cadets’ counsel pointed out that these trainees do not get ex-servicemen status and hence are denied insurance and other basic benefits.

Expressing concern, the Bench remarked:
“But for the disability, they would have joined the forces. This is unfortunate as the accidents are not due to their fault. Even if they don’t get ex-servicemen status, they must get some benefits.”

The Court clarified it would not interfere in similar cases already pending before High Courts.
