Supreme Court Dismisses Plea Against 20% Ethanol-Blended Petrol (E20)
The Supreme Court on Monday dismissed a public interest litigation (PIL) challenging the rollout of 20% ethanol-blended petrol (E20) without giving consumers the option to choose ethanol-free fuel.
A Bench of Chief Justice of India (CJI) BR Gavai and Justice K Vinod Chandran rejected the plea after the Central government opposed it, stating that E20 directly benefits sugarcane farmers. The Court also questioned the petitioner’s credentials before dismissing the case.
The petition, filed by advocate Akshay Malhotra, argued that most vehicles manufactured before April 2023 are not compatible with E20 fuel. Even BS-VI compliant vehicles made just two years ago may face engine issues if used with 20% ethanol-blended petrol.
Senior Advocate Shadan Farasat, appearing for the petitioner, argued that while E20 is a step towards cleaner fuel, consumers should be given a choice. He pointed out that many vehicles require engine modifications and calibration to run on E20, and the lack of non-ethanol petrol options is unfair to existing car owners.
The plea further claimed that ethanol blending can cause engine corrosion, reduce fuel efficiency, and lead to premature wear and tear, which may not be covered by manufacturers or insurance companies.
It also highlighted that in countries like the USA and EU, ethanol-free fuel is available alongside blended petrol with clear labelling. However, in India, consumers are not informed about the ethanol content of fuel at petrol pumps.
The petitioner had sought directions to ensure availability of ethanol-free petrol, compulsory labelling of ethanol content, enforcement of consumer rights, and a nationwide study on the impact of E20 on vehicles.
Attorney General R. Venkataramani, representing the government, strongly opposed the plea, remarking that “sugarcane farmers are benefitting from this” and questioning why an outsider should dictate India’s fuel policy.
With this, the Supreme Court dismissed the petition, clearing the way for the continued rollout of E20 fuel across the country.
